1. General
Welcome to hamenagen.co.il (the "Site"), operated by Nitai Mordechai - Live Event Musician (referred to as "us", "the performer" or "Nitai"). Use of the site and the services offered on it constitutes acceptance of the terms detailed in this document.
2. Services Offered
The site presents and promotes live music services for events, including:
- Piano and guitar performance at weddings
- Live music for bar and bat mitzvah events
- Performance at henna ceremonies and traditional events
- Music for corporate and business events
- Background music services for private events
Service details, repertoire, and the final offer are tailored personally with each client for each event.
3. Booking
3.1 Initial Inquiry
Service booking is done by phone, through the site's contact form, WhatsApp, or email. Any pricing reference on the site is indicative only and requires final confirmation in conversation.
3.2 Agreement and Summary
After preliminary coordination, the client will receive a written summary (WhatsApp/email) including:
- Date, time, and event location
- Service type ordered and performance duration
- Final price and payment terms
- Additional details agreed upon (music style, special requests)
The client's confirmation of the summary constitutes a binding agreement.
4. Payment
- Payment terms are determined specifically for each event and will be detailed in the summary.
- Typically a deposit is required to reserve the date, with the balance on or before the day of the event.
- Payment methods: bank transfer, Bit, or cash (by arrangement).
- Tax invoice/receipt will be provided to the client upon completion of payment.
5. Cancellations and Changes
5.1 Cancellation by Client
- Cancellation up to 60 days before the event: Full refund of the deposit.
- Cancellation 30-60 days before the event: 50% refund.
- Cancellation less than 30 days before the event: No refund, as the date was reserved and other inquiries were declined.
- Cancellations due to force majeure events: Will be examined on a case-by-case basis where possible.
5.2 Cancellation by Performer
In the rare event of personal or medical constraints, every effort will be made to offer a replacement musician of similar quality, or to refund the full amount paid.
5.3 Date Change
Date change will be examined subject to availability. If impossible, the cancellation terms above apply.
6. Liability
- We undertake to arrive on time, with functioning equipment, and to provide professional service as agreed.
- We are not responsible for malfunctions stemming from the venue (electricity, location, environmental noise, etc.).
- The client must ensure suitable performance conditions: electricity, speaker connection point, and seating/standing space.
- In the absence of minimum conditions — an effort will be made to adapt, but we will not bear responsibility for quality issues.
7. Intellectual Property
All content on the site — including photographs, videos, texts, logos, and music recordings — is the exclusive property of Nitai Mordechai. It is forbidden to copy, distribute, publish, or make any commercial use without explicit written permission.
Recordings and photographs made during an event remain the client's property, but we reserve the right to use them for promotional purposes (portfolio, social media), subject to the client's approval.
8. Client-Provided Content
If the client requests a specific song not in our repertoire, the client declares that there is no copyright infringement related to the private event. We will not bear responsibility for public performance of protected works that require licensing from ACUM or others.
9. Third-Party Services
The site may include links to third-party services (Google Forms, WhatsApp, social media). Use of these services is subject to their terms and privacy policies, and we are not responsible for their operation.
10. Changes to Terms
We may update these terms from time to time. The current version will be posted on this page with an updated revision date. A booking that has already been confirmed will remain subject to the terms in effect at the time of booking.
11. Jurisdiction
These terms and use of the site are subject to Israeli law. Any dispute will be heard exclusively in a competent court in the Tel Aviv-Yafo area, Israel.
